Article 2. Applicability and conditions

  1. Our terms and conditions apply to all agreements with you as a customer. Certain conditions only apply to consumers (any natural person who acquires or uses products or services marketed exclusively for non-professional purposes). This is then clearly stated.
  2. We deliver only in Belgium. If you provide a delivery address in another country, we may refuse your order.
  3. To place an order, you must be at least 18 years old. If you are not 18, a parent or legal guardian must place your order. If we find that a minor has placed an order, we may still refuse that order.
  4. You can always find our terms and conditions on our website. Placing an order on the website constitutes express acceptance of our general terms and conditions of sale. You can always find these on our website. If you order online, we also provide you with a copy of these terms and conditions along with the order confirmation (or at the latest upon delivery) in a format that you can save or print.
  5. If additional special terms and conditions apply in addition to these general terms and conditions, the above also applies to the special terms and conditions. Should our general terms and conditions conflict with those special conditions, you, the consumer, can always invoke the text most favorable to you.

Article 3. Our offer and your order

  1. If an offer has a limited validity period or is subject to certain conditions, we expressly state this in that offer.
  2. We always describe as completely and accurately as possible what we are selling you and how the ordering process will go. In any case, the description is sufficiently detailed so that you can make a proper assessment. If we use images, they are a true representation of the goods and/or services offered. Colors in images may deviate from reality to a certain extent and the reproduction in your home may depend on the quality of the monitor you are using.However, to err is human. Therefore, if we are obviously mistaken, we are under no obligation to still deliver.
  3. To purchase a product, add the product to your shopping cart. Afterwards you fill in your contact details, delivery details, billing details. Then you choose your mode of delivery. Either we deliver to your home or you choose delivery to a pickup point or bpost’s automatic parcel machine. In the last step, you get an overview of your order, accept our terms and conditions and confirm your payment by pressing the order button labelled “PLACE AND PAY ORDER”. Once you have completed these steps, your order is final.
  4. Your order is complete and the agreement between us is final once we confirm your order by email and once we receive approval from the card issuer for your payment transaction. If your card issuer refuses to agree to your payment to us, we cannot be held responsible for delays in delivery and/or non-delivery of your order. Orders without valid payment in the name of the registered cardholder will not be accepted or processed.

Article 4. Right of withdrawal

  1. If you buy goods or services from us as a consumer, you have 14 days to decide that you do not want to keep the goods or services. This 14-day period starts from delivery. You can then return your order, without paying any compensation and without having to give a reason (you pay the shipping costs for this yourself).
  2. You must return the goods to us within 14 days of letting us know that you wish to withdraw from the contract. You are responsible for the cost of returning the goods.
    You can return the goods via post with a track and trace system or a courier.
  3. We will refund you the full purchase price within 14 days after we have received your order back or after you have indicated that you wish to withdraw from the contract, whichever comes first.The refund will include the original delivery cost, unless you have chosen a different delivery method than the cheapest standard delivery offered by us when you placed your order.The refund will be made using the same means of payment that you yourself used to pay.
  4. During the first 14 days after delivery, we expect you to handle the order and its packaging with care. If you still wish to return the goods, you may only unpack or use them to the extent necessary to assess whether you wish to keep the good (as you might do in a store). For example, returned goods may be fitted but not used. If you return the goods, this must be done with all delivered accessories, in their original condition, if possible together with the original packaging, and taking into account our instructions.If you go beyond what was necessary to assess the properties of the goods and the good is reduced in value as a result, we may apply a proportionate reduction in value to the refund.
  5. Consumers cannot exercise their right of withdrawal if the delivered goods are manufactured according to the customer’s specifications or are clearly intended for a specific person. Goods purchased with discounts cannot be returned.
  6. To exercise your right of withdrawal quickly and correctly, please fill out the return form found on the website and send it to Sebastian, Ritmeesterlaan 13, 8450 Bredene, info@lewis-brussels.com. We will send you a confirmation of receipt of your revocation by e-mail.

Article 5. Price

  1. During the period mentioned in our offer, our prices do not change, except for price changes due to changes in VAT rates.
    Our prices include all taxes, VAT, duties and services. So you will never be surprised.
  2. However, we may decide to charge shipping costs on top of the purchase price. In that case, we always notify you before you finalize your order.

Article 6. Payment

  1. We can only accept payment through the payment modules on our website.
  2. We accept Bancontact, Mastercard and Visa as means of payment.
  3. To ensure safe online payment and the security of your personal information, we use SSL technology. SSL ensures that your transaction data is encrypted and rendered unreadable when transmitted over the Internet. No special software is required to pay with SSL. You can recognize a secure SSL connection by the “lock” in the lower status bar of your browser.

Article 7. Conformity and warranty

  1. We guarantee that our goods conform to your order and meet the normal expectations you may have of them, taking into account the specifications of the product. Of course, we also guarantee that our goods comply with all laws as they exist at the time of your order.
  2. If the delivered goods do not conform to your order, as a consumer you are entitled to the statutory two-year warranty. This means that if you discover a hidden defect or fault within two years of the delivery of the good, you can have it repaired or replaced by us free of charge.Insofar as this is possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive or impossible, or cannot be carried out within a reasonable time, do you have the right to demand a price reduction or rescission of the sales contract.
    If the defect or flaw manifests itself within the warranty period (2 years after delivery), it is deemed to have existed before delivery unless we can prove otherwise.

Article 8. Delivery and execution

  1. All goods and services will be delivered to the address you provided when you placed your order. Incorrectly provided delivery addresses are the responsibility of the buyer and may result in additional charges at the buyer’s expense.
  2. If the items are in stock, the average delivery time for delivery in Belgium after payment is in principle 1 to 5 working days unless otherwise indicated on our website. When an ordered item is not in stock, the delivery time will rather be 3 to 6 working days. If materials are exhausted in our stock, we will promptly refund any payment you have made. Sebastian is not responsible for late deliveries by the postal company or courier service. The stated delivery times are provided for information purposes only and will be adhered to as much as possible.
  3. Deliveries are made via bpost to the extent possible via letterbox boxes or, for larger packages, via postal boxes. The consumer indicates in the delivery details whether the package is to be delivered to the indicated delivery address or to a pick-up point indicated by the consumer on the website.
  4. If we cannot deliver on time, we will always notify you before the expiration of the scheduled delivery period. We will then agree a new delivery date with you. If we also fail to meet this second deadline, you, the consumer, may cancel the contract free of charge. We will then refund you within 30 days of cancellation. If we do not notify you before the expiration of the initially foreseen delivery date, you, as a consumer, may already immediately dissolve the contract free of charge at the expiration of this period. We will then refund you within 30 days of cancellation.
  5. Our shipments are always done at our risk. So you don’t have to worry about goods getting lost or damaged in the mail. However, if you return goods to us within 14 days of purchase because you prefer not to keep them (see article 4), you are responsible for their transportation.
  6. You must report visible defects as soon as possible and certainly within 3 days of delivery with attached photos of packaging and damaged or non-conforming goods. When we talk about visible defects, we think for example of goods that were damaged during transport, do not match the items listed on the delivery note or do not match the items you ordered (visible defects).
  7. We are not responsible for any consequential damages due to late delivery or non-delivery by our carrier. In any event, our liability is limited to the value of the items you prove you did not receive.

Article 9. Force Majeure

  1. In case of force majeure, we are not obliged to fulfill our contractual obligations. In this case, we may either suspend our obligations for the duration of the force majeure situation or terminate the contract permanently. Since there is a force majeure situation, we do not owe you any compensation in this regard.
  2. Force majeure is any circumstance beyond our will and control that prevents the performance of our obligations in whole or in part. By this we mean, among other things, strikes, fires, business disturbances, energy failures, disturbances in a (telecommunications) network or connection or communication systems used and/or the unavailability of our website at any time, non-delivery or non-timely delivery of suppliers or other third parties engaged, …

Article 10. Intellectual property

  1. Our website, logos, texts, photographs, names and all our communications in general are protected by intellectual property rights vested either in us, our suppliers or other rights holders.
  2. You are prohibited from using and/or modifying the intellectual property rights described in this article. For example, you may not copy or reproduce drawings, photos names, texts, logos color combination, etc … without our prior and express written consent.

Article 11. Complaints procedure and disputes.

  1. Of course, we always hope that all our customers are 100% satisfied. Should you have any complaints about our services, please contact us at our email address info@lewis-brussels.com. We will do our best to handle your complaint within 7 days.
  2. All agreements we conclude with our customers, regardless of their place of residence, are governed exclusively by Belgian law. If, for reasons of international law, a different law does apply, the interpretation of these general terms and conditions will primarily refer to the Belgian Market Practices and Consumer Protection Act as included in the Economic Law Code.In case of disputes, only the competent Belgian courts are competent.
  3. As a consumer, you also have the option of resolving the dispute out of court. You can contact the Consumer Ombudsman Service of the Federal Government for this purpose. It is authorized to receive any request for out-of-court settlement of consumer disputes. It will in turn either handle the request itself or forward it to a qualified entity. If your complaint is accepted by Becom, it will mediate between us and you as a customer in a neutral way. Please note that only complaints submitted via the complaint form on https://becom.digital/nl/consumers-complaints/ will be handled. This way Becom immediately has all the correct information to further handle your complaint.
